Terms of Use for “My Private Gym”

1) Scope
These Terms of Use govern your use of the iOS app “My Private Gym” (the “App”), provided by aurarum, H. Klindtworth, Gorch-Fock-Ring 26, 23683 Scharbeutz, Germany (“aurarum”). By installing and using the App, you accept these terms. Processing of personal data is governed by our Privacy Policy; see also our legal notice.
The App is currently free to use. No aurarum account is required.
2) License to use
aurarum grants you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, solely for private, non-commercial purposes in accordance with these terms and applicable law.
You may not decompile, reverse engineer, reproduce, distribute, rent, lease, or make the App available to third parties for a fee, except where mandatory law permits otherwise. The built-in exercise catalog and other App content are protected by copyright and may not be extracted or redistributed without aurarum’s consent.
3) Health and fitness notice
The App helps you log and analyze training. It does not replace medical, physiotherapy, or coaching advice. Workout suggestions, statistics, and exercise descriptions are guidance only. You are solely responsible for assessing your physical suitability and consulting a physician or qualified professional before training if you have health questions or symptoms.
4) On-device workout suggestions
Personalized workout suggestions are calculated on your device and learn from your workouts and corrections. They are suggestions — you decide whether to accept them or enter your own values. aurarum does not guarantee that suggestions are suitable for every user or training goal.
5) User content and responsibility
Workout data, plans, measurements, photos, and other content you create or import in the App generally remain on your device (optionally synced via your private iCloud). You are responsible for the accuracy, legality, and backup of your content. aurarum does not actively review your content.
6) Optional Apple services
Features such as iCloud sync, Apple Health, camera, photo library, notifications, or AlarmKit are optional and used only after you enable or grant permission. Apple’s terms and privacy policies apply to these services. See our Privacy Policy for details on data processing.
7) External links
The App may open links to external services, for example a YouTube search for an exercise name. aurarum does not operate or control these services and does not adopt third-party content. Use of external services is at your own responsibility and subject to their terms.
8) Feedback
You may voluntarily send feedback through the App. By sending feedback, you agree that the information you provide will be processed as described in our Privacy Policy. Workout, Health, or photo data is not included.
9) Availability and changes
aurarum strives for a stable App but does not guarantee uninterrupted availability. Features may be developed, changed, or discontinued. aurarum may update these Terms of Use when required for legal, technical, or operational reasons. The published version applies.
10) Liability
aurarum is liable without limitation for intent and gross negligence and for injury to life, body, or health. For slight negligence in breach of essential contractual obligations, liability is limited to foreseeable typical damage. Otherwise, liability is excluded to the extent permitted by law, without prejudice to mandatory statutory claims such as under product liability law.
You use the App at your own risk. To the extent permitted by law, aurarum is not liable for training injuries, health damage, or data loss arising from use of the App, incorrect entries, or failure to heed the health notice.
11) Apple App Store
The App is distributed through the Apple App Store. Purchase, licensing, and use via the App Store are also subject to Apple’s terms, including the Apple Standard End User License Agreement (EULA). If Apple’s EULA conflicts with these Terms of Use regarding App Store use, Apple’s EULA prevails to that extent.
12) Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection rules of your country of residence provide otherwise. Place of jurisdiction is, where permitted by law, aurarum’s registered office.
